1. Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of OptionExpert, including our website, mobile applications, APIs, data displays, analytics tools, alerts, subscriptions, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Nature of the Service
OptionExpert provides informational and analytical software tools, which may include options data displays, implied volatility calculations, Greeks and time decay estimates, options strategy builders, unusual order flow analytics, AI-generated market briefs, news summaries, alerts, watchlists, charts, and risk analysis tools.
OptionExpert is an informational and analytical software service. We do not provide brokerage services, investment advisory services, personalized financial advice, tax advice, or legal advice. You are solely responsible for your trading and investment decisions.
We do not execute trades, route orders, custody assets, manage accounts, or act as a broker, dealer, introducing broker, futures commission merchant, commodity trading advisor, investment adviser, or exchange.
3. Eligibility and Accounts
You must be legally able to use the Service in your jurisdiction and legally able to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
We may suspend or terminate accounts that violate these Terms, create legal or operational risk, abuse the Service, attempt to bypass access controls, or use the Service in a way that may harm other users, data providers, payment processors, or OptionExpert.
4. No Financial Advice
The Service may display securities, ETFs, options contracts, volatility metrics, signals, alerts, summaries, calculations, model outputs, and other market-related information. This content is for informational and educational purposes only.
No content in the Service should be interpreted as a recommendation to buy, sell, hold, or trade any security, ETF, option contract, futures contract, digital asset, or financial instrument. The Service does not take into account your personal financial situation, investment objectives, risk tolerance, tax status, trading experience, liquidity needs, or other individual circumstances.
You should consult a qualified and licensed financial, legal, or tax professional before making financial decisions.
5. User Responsibilities
You agree that you will not:
- use the Service for unlawful trading, market manipulation, fraud, spoofing, wash trading, insider trading, or any other unlawful activity;
- resell, redistribute, sublicense, scrape, or commercially exploit market data, news, analytics, alerts, API responses, or Service content unless we expressly authorize it in writing;
- attempt to reverse engineer, overload, bypass, or interfere with the Service, APIs, rate limits, security controls, or access restrictions;
- share paid accounts, subscription access, API keys, or other credentials with unauthorized users;
- misrepresent the Service as providing guaranteed trading results, personalized investment advice, or trade execution;
- use the Service in a way that violates third-party data provider terms, payment processor rules, applicable laws, exchange rules, or regulatory requirements.
6. Subscriptions, Trials, Billing, and Cancellation
Some features may require a paid subscription. We may offer a free trial, including a 3-day trial, at our discretion. Trial terms, pricing, renewal frequency, and included features will be shown at checkout or in the Service.
Paid subscriptions may automatically renew unless cancelled before the renewal date. Payments may be processed by PayPal or another third-party payment processor. By subscribing, you authorize the applicable payment processor to charge your selected payment method according to the subscription terms shown at checkout.
You may cancel your subscription at any time. Unless otherwise stated, cancellation stops future renewals but does not automatically refund the current billing period. You may continue to access paid features until the end of the paid period, subject to these Terms.
Refunds are governed by our Refund Policy.
7. Data, News, Alerts, and AI Content
Market data, options data, news, AI-generated content, signals, alerts, calculations, and summaries may be delayed, incomplete, inaccurate, unavailable, or affected by third-party errors. We may use third-party data providers, news providers, cloud services, analytics providers, and AI providers.
We do not guarantee the accuracy, completeness, timeliness, availability, or fitness of any data, calculation, model, alert, signal, summary, or AI-generated output. You must independently verify information before relying on it.
8. Availability and Changes
The Service may be interrupted, delayed, degraded, or unavailable due to maintenance, market data outages, exchange issues, cloud failures, network issues, software bugs, third-party restrictions, or events beyond our control. We may modify, suspend, remove, or discontinue features at any time.
9. Intellectual Property
The Service, including software, design, text, graphics, workflows, calculations, models, interfaces, and other content, is owned by OptionExpert or its licensors and is protected by intellectual property laws. You may use the Service only as permitted by these Terms.
10. Third-Party Services
The Service may integrate with third-party services such as PayPal, cloud hosting providers, market data providers, news providers, analytics tools, crash reporting tools, and AI providers. Your use of third-party services may be subject to their own terms and policies. We are not responsible for third-party services.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.
12. Limitation of Liability
To the maximum extent permitted by law, OptionExpert and its owners, employees, contractors, affiliates, licensors, and service providers will not be liable for trading losses, investment losses, lost profits, lost data, business interruption, reputational harm, indirect damages, incidental damages, consequential damages, punitive damages, or losses caused by data errors, delays, outages, model errors, AI errors, alerts, signals, or user decisions.
To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to OptionExpert for the Service during the three months before the event giving rise to the claim, or USD $100 if you paid nothing.
13. Indemnification
You agree to defend, indemnify, and hold harmless OptionExpert and its owners, employees, contractors, affiliates, licensors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Service, your violation of these Terms, your violation of law, or your infringement of third-party rights.
14. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate your access if we believe you violated these Terms, created risk, failed to pay, abused the Service, or if we are required to do so by law, a data provider, payment processor, infrastructure provider, or other third party.
15. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction where OptionExpert is operated, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@optionexpert.app and attempt to resolve the dispute informally.
The final governing law, venue, arbitration, class action waiver, and dispute process should be confirmed by counsel based on the entity, user locations, and launch jurisdictions.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on our website or in the Service. Your continued use of the Service after changes become effective means you accept the updated Terms.
